Stay Ahead of the Game: A Comprehensive AI Policy Tracker for Health Care Professionals

A new tool from Manatt, the Health AI Policy Tracker, is designed to help policymakers and industry professionals keep track of the most important federal and state policy activity related to AI in the health care sector. The tracker covers both federal legislative and regulatory activity up until the present date, as well as state legislative activity introduced between January 1st and March 31st, 2024. Updates will be made quarterly, with the next scheduled for June 2024.

The legal and regulatory landscape surrounding AI is constantly evolving as policymakers at both the federal and state levels seek to strike a balance between harnessing its transformative potential and addressing concerns about safety, security, privacy, accuracy, and bias. Currently, there is no specific federal law governing AI; however, several agencies including the White House are working on proposed regulations to govern its use. Entities such as the Office of the National Coordinator for Health Information Technology (ONC), Centers for Medicare and Medicaid Services (CMS), Office of Civil Rights (OCR), Food and Drug Administration (FDA), Department of Justice (DOJ), and Federal Trade Commission (FTC) are all actively involved in developing laws and regulations related to AI. The level of activity in this area is expected to increase in the second half of 2024 due to deadlines set by President Biden’s Executive Order on responsible AI.
